Lenders of are given access to only the Judicial Foreclosure method. Unlike the other states, Pennsylvania foreclosure laws does not encourage Non- Judicial or "Power of Sale" Foreclosure process. The timing taken for the completion of the process is 90 days. All disputes regarding foreclosure must be done through the courts.

Addition to that, in Pennsylvania only deficiency Judgments are permissible to the lender that to within 6 months the lender must file for the deficiency judgment. The Right of Redemption is denied to the borrowers in Pennsylvania. The lender must clearly mention the purpose of the foreclosure in the notice. The notice must also state that if the borrower fails to pay the default within 30 days, then the lender can accelerate the mortgage payments. And suppose the borrower is unable to pay the default amount within 30 days, including the late charges or penalties that are added, and then the lender can file a suit to try and obtain the order from the court to foreclose the property.

Continuing With The Pennsylvania Foreclosure Process

Suppose the court finds positive evidences from the lender, it will issue an order for the foreclosures sale of the distressed properties. The sale is usually performed in the foreclosure auction, which takes place in front of the county courthouse, the foreclosed hud homes is awarded to the highest bidder. The Sheriff conducts and oversees the auction. The borrower is given the chance to recover the foreclosed homes. This can be achieved between the issue of court order up to the hour before the sheriff's foreclosure sale. If the borrower still fails to pay the default, then he is denied the right of redemption.
